PROBATE FAQ

What is probate?
Probate is the formal legal process that gives recognition to a will and appoints an executor to administer the estate and distribute assets to beneficiaries.
Can I contest a will in Connecticut?
Yes — if you have standing (typically an heir or beneficiary) and grounds such as undue influence, lack of capacity, fraud, or improper execution. Deadlines are short, so act quickly.
What is undue influence?
When someone pressures or manipulates a person into changing their will or making transfers that don't reflect their true wishes — often targeting the elderly or ill. It's one of the most common grounds for a will contest.
What can I do if the executor is mishandling the estate?
Executors and trustees owe fiduciary duties to the beneficiaries. If assets are disappearing, accountings don't add up, or the administration is being neglected, the probate court can compel accountings, remove the fiduciary, and order recovery of losses.
How long do probate disputes take?
It varies with the complexity of the estate and how contested the matter is. Some resolve in months through negotiation; heavily litigated contests take longer. Tom gives you a straight assessment up front.
